Judicial and extrajudicial investigations

Judicial and extrajudicial investigations, as well as the criminal investigations, shall also be performed by specialists without Romanian citizenship.

According to a bill of law for the amendment and completion of the Government Ordinance No. 2/2000 on the organization of the judicial and extrajudicial investigation activity and of the Government Ordinance No. 75/2000 on the authorization of crime experts, the Government decided yesterday that the citizens of member states are also allowed to practice in Romania jobs like judicial and extrajudicial technical expert or crime expert.

The bill of law aims to remove the prerequisite that restricts the exercise of judicial and extrajudicial technical expert and crime expert jobs to Romanian citizens only. These jobs can also be practiced in Romania by the citizens of member states of the European Union, as well as of European Economic Area, including the Romanian citizens who have obtained the necessary professional qualifications in these states.

The bill of law also regulates the situation of citizens of other member states of the European Union or from the European Economic Area, who intend to perform judicial and extrajudicial investigation activities, respectively criminal investigation in Romania, on a temporary or occasional basis. The bill of law provides this possibility differently, indicating that such persons are exempted from examination.

At the same time, another situation was also provided where, in order to exercise the job of judicial, extrajudicial or crime expert on a temporary basis, the applicant is at the first departure to Romania. In this case, certain proceedings must be observed: proof of citizenship, certificate of Romanian language knowledge, proof of professional qualification, a certificate attesting the fact that the applicant is legally residing in a member state for the purpose of performing such activities and that he has no restrictions to practice the job, even on a temporary basis, at the date of issue of the certificate, and also for the case in which the job is not regulated in the country of residence, the proof that he had performed a job-specific activity for at least two years, over the past ten years.
